Operator Terms of Service

These Terms govern your use of Jareb as a home-food-business operator. By creating or using a Jareb Order Page, you agree to them. If you do not agree, do not use the Service.
Who operates this service

Definitions
- "Jareb", "we", "us", "our" — the Jareb platform and software, operated by TRY F&B TECHNOLOGIES (sole establishment, Dubai, UAE).
- "Operator", "you", "your" — the home-food business that creates or uses a Jareb Order Page.
- "Customer" — a person who views your Order Page or contacts you to place an order.
- "Order Page" — your public Jareb page (at
jareb.ae/k/your-name) that shows your menu and routes Customers to your WhatsApp. - "Owner Link" — the private link containing an access token used to manage your Order Page.
- "Content" — the business name, item names, descriptions, prices, photos, and other material you upload to Jareb.
- "Service" — the Jareb software, Order Pages, and related features.
1. The Jareb service and our role
1.1 Jareb provides software that lets you publish a menu and an order page (at jareb.ae/k/your-name) and routes interested customers to your own WhatsApp to place an order.
1.2 Jareb is a facilitator and software provider only. Jareb is not the seller, maker, handler, or deliverer of any food. Jareb does not take payment for your food, does not prepare or transport it, and is not a party to any sale, contract, or transaction between you and your customers.
1.3 The sale of food, all communication after the Customer reaches WhatsApp, fulfilment, delivery or pickup, pricing, refunds, and food safety are your sole responsibility.
2. Eligibility and your licence to sell
2.1 You confirm you are at least 18 years old and may lawfully sell the food you list in the United Arab Emirates.
2.2 You represent and warrant that you hold and will maintain all permits, approvals, food-safety training/certifications, trade or home-business permissions, and any municipality, DED, or other approvals required for your activity and location. Jareb may perform a limited, reasonable-effort review of documents you submit, such as checking whether a licence appears current and whether its stated activity broadly matches the business listed. This administrative review is not certification, legal verification, endorsement, or a guarantee of authenticity, ownership, food safety, or continuing compliance. You remain solely responsible for obtaining and maintaining all required licences, permits, approvals, and compliance.
2.3 You will comply with all laws applicable to your business, including food-safety, allergen, labelling, hygiene, consumer-protection, advertising, tax, and delivery/pickup laws. You will not list controlled or prohibited items or make medical or health claims. Where legally required, you will accurately disclose allergens and ingredients and answer customer allergy questions truthfully.
2.4 You warrant that you own or are licensed to use all content you upload (business name, item names, descriptions, photos) and that it does not infringe anyone's rights.
3. Your account and access link
3.1 Your order page is managed through a private owner link containing an access token. Keep this link confidential and do not publish it — anyone with it can edit your page. You are responsible for activity carried out through your link.
3.2 The owner link is a convenience access token, not a password. Jareb may reset or revoke it for security or suspected misuse. Tell us at hello@jareb.ae if your link is exposed; you may request a reset.
3.3 You warrant that the WhatsApp number linked to your page is owned and controlled by you and can receive customer messages.
4. Acceptable use, content, and risk response
4.1 You will not list anything illegal, unsafe, misleading, or that you are not entitled to sell, and your content — including business or item names, descriptions, and photos — must not be offensive, obscene, hateful, defamatory, or otherwise inappropriate. You will not use Jareb to harass, defraud, or harm anyone, or to upload malware or attempt to disrupt the service.
4.2 You are responsible for the accuracy of your menu, prices, availability, and WhatsApp number. Out-of-date or wrong information (including a wrong or dead WhatsApp number) is your responsibility.
4.3 Jareb may request, at any time, evidence of your licensing, identity, WhatsApp ownership, or compliance. Jareb may suspend or remove a page (in whole or part) on credible complaint, regulator request, suspected food-safety risk, misleading content, a wrong WhatsApp number, suspected unlicensed activity, or your failure to respond — in its reasonable judgement, to protect customers, third parties, or Jareb. Where practical, Jareb will tell you why.
4.4 You must promptly notify Jareb (hello@jareb.ae) of any food-safety complaint, regulatory complaint, recall, illness or allergy allegation, or licensing issue connected to orders generated via Jareb. Jareb may share complaint information with competent authorities where required or appropriate.
5. Service provided "as is"; no uptime guarantee
5.1 Jareb is provided "as is" and "as available". To the fullest extent permitted by UAE law, Jareb does not promise that the service will meet your requirements, generate any sales or customers, be uninterrupted, error-free, or secure, or remain available — except for obligations that cannot be excluded under UAE law.
5.2 Jareb does not guarantee any level of uptime, availability, performance, customer volume, or sales. Outages, bugs, maintenance, and third-party failures (including WhatsApp/Meta, hosting/CDN, and network providers) may occur.
6. Force majeure
Jareb is not responsible for any failure or delay caused by events beyond its reasonable control, including telecommunications or network failures, hosting/CDN provider outages (e.g. our infrastructure provider), WhatsApp/Meta outages or changes, cyber incidents not caused by Jareb's failure to use reasonable security, government or regulatory action, and emergency maintenance.
7. Limitation of liability
7.1 To the fullest extent permitted by UAE law, Jareb is not liable for any indirect, incidental, special, or consequential loss, nor for any loss of profits, sales, customers, revenue, goodwill, or business interruption, arising out of or relating to your use of (or inability to use) Jareb — including any downtime, broken or mis-routed link, lost order, or data loss — whether the claim is in contract, tort, or otherwise, and even if Jareb was advised such loss was possible.
7.2 To the fullest extent permitted by UAE law, Jareb's total aggregate liability to you for direct, proven losses relating to the service is limited to the greater of (a) the fees you actually paid Jareb in the 3 months before the event giving rise to the claim, or (b) AED 100 while the service is provided free of charge.
7.3 Nothing in clauses 5–7 excludes or limits any liability that cannot be excluded or limited under UAE law, including liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by Jareb, harmful acts that cannot be excluded under the UAE Civil Code, or any mandatory consumer-protection or data-protection obligations.
8. Your indemnity to Jareb
You agree to indemnify and hold Jareb harmless from any claim, loss, liability, fine, or cost (including reasonable legal fees) arising out of: (a) the food you sell, prepare, handle, or deliver — including any illness, allergy, injury, or food-safety claim; (b) your fulfilment, delivery, refunds, or dealings with customers; (c) your content or your breach of these Terms or applicable law; or (d) your licensing or tax obligations.
9. Fees
9.1 Jareb is currently provided free of charge. Jareb may introduce paid plans in future; it will give you reasonable notice, and no charge will apply without your affirmative opt-in and payment setup. You may stop using Jareb or delete your page before any paid terms apply. Paid terms (including any change to the liability cap in clause 7.2) will be made clear before you are charged.
10. Your data and privacy (Operator)
10.1 To provide the service, Jareb collects and publishes the business data you give it: your business/display name, WhatsApp number, menu items, descriptions, prices, and photos. Your WhatsApp number and business name are shown publicly on your order page and in the customer's pre-filled WhatsApp message.
10.2 Jareb also holds your owner access token and any contact details or evidence you provide. Jareb processes this to operate, secure, and support the service, consistent with the UAE PDPL (Federal Decree-Law No. 45 of 2021). Jareb uses hosting/security/CDN service providers that may process technical data outside the UAE, subject to PDPL-permitted safeguards.
10.3 On deletion of your page (clause 11.1), Jareb removes your published content; limited records may be retained where needed for legal, security, or accounting purposes. You may exercise PDPL rights (access, correction, deletion, objection, where applicable) by emailing hello@jareb.ae.
10.4 If you ever upload or collect your customers' personal data through any future Jareb feature, you remain the controller of that data and Jareb's role will be separately documented.
11. Suspension and termination
11.1 You may stop using Jareb at any time and request deletion of your page by emailing hello@jareb.ae.
11.2 Jareb may suspend or end your access if you breach these Terms, if required by law, or if continuing would expose Jareb or others to material risk. Clauses that by their nature should survive — including those on Jareb's role (1.2), disclaimers (5), liability (7), indemnity (8), data (10), IP (13), and the general provisions (14) — survive termination.
12. Relationship of the parties
Nothing here creates any employment, agency, partnership, or joint venture between you and Jareb. You act as an independent business.
13. Intellectual property
13.1 You keep all rights in your own content. You grant Jareb a non-exclusive, royalty-free licence to host, display, share, index, and promote your Jareb page and the Jareb service — including page rendering, share assets, social previews, and directory listings. For paid advertising or testimonials featuring your name or photos as a case study, Jareb will obtain your consent.
13.2 The Jareb name, brand, and software remain Jareb's property. These Terms grant you no rights in them beyond using the service as intended.
14. General
14.1 Changes to these Terms. Jareb may update these Terms. Material adverse changes take effect after reasonable notice (e.g. notice on your owner page or by email), except urgent legal or security changes. Continuing to use Jareb after changes take effect means you accept them. Jareb will keep a dated/versioned copy of the current Terms.
14.2 Notices. Jareb may give notice by your owner page, by email if you provided one, by website notice, or by WhatsApp if you voluntarily provided a number. Your legal notices to Jareb go to hello@jareb.ae; for urgent food-safety or regulatory matters, use a clear subject line.
14.3 Assignment. You may not transfer your rights or access token without Jareb's consent. Jareb may assign or transfer these Terms to a successor, affiliate, or restructured legal entity (for example on conversion from a Sole Establishment to an LLC), with notice where required and without reducing your mandatory rights.
14.4 Severability. If any provision is invalid or unenforceable, it will be modified to the minimum extent necessary to be enforceable, or severed, and the remaining provisions stay in effect.
14.5 Entire agreement. These Terms are the entire agreement for the free service, except any written paid-plan terms and any mandatory law. They do not override your consumer or data-protection rights.
14.6 Governing law and forum. These Terms are governed by UAE federal law as applied in the Emirate of Dubai, and the onshore Dubai Courts have jurisdiction, subject to any mandatory jurisdiction or consumer/data-protection rights you may have under UAE law.
